Oral arguments in the lawsuit challenging the 2015 Telephone Consumer Protection Act (TCPA) order began Wednesday in the D.C. Circuit Court of Appeals. CUNA filed an amicus brief in the case, and Senior Directors of Advocacy and Counsel Leah Dempsey and Andy Price were in attendance Wednesday.
CUNA’s concerns arise from the July 2015 Federal Communications Commission (FCC) omnibus declaratory ruling and order for the TCPA, which it believes is problematic and has impacted credit unions’ ability to communicate with members about pertinent account information.
A panel consisting of D.C. Circuit Court of Appeals Judges questioned counsel for the petitioners, as well as FCC's counsel, for nearly 3 hours.
